Terms of Service

1. Introduction and Acceptance

Welcome to HabitPact. These Terms of Service ("Terms") govern your use of the HabitPact mobile application (iOS and Android) and the website at gethabitpact.com (together, the "Service"), operated by an individual developer based in Poland ("we", "us", "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service. We recommend reading these Terms together with our Privacy Policy, which explains how we handle your personal data.

If you are under 16 years of age, you may not use the Service. By using HabitPact, you confirm that you are at least 16 years old.

2. What HabitPact Does

HabitPact is a daily habit tracking application that lets you set goals, track habits, build streaks, and earn rewards. You can use it on your own (solo mode) or together with a partner (pair mode).

2.1 Free Tier

The free tier includes:

  • Solo mode
  • Up to 5 habits
  • 1 active goal
  • Basic progress statistics

2.2 Premium Tier

Premium is available as an in-app purchase and adds:

  • Pair mode (shared habit tracking with a partner)
  • Unlimited habits and goals
  • Trend charts and detailed insights
  • Pair insights (side-by-side progress with your partner)
  • Home screen widgets

Premium subscriptions are processed and managed through Apple App Store or Google Play. The pricing, billing cycle, and renewal terms are displayed in the respective store before purchase. We do not process payments directly.

3. Your Account

To use HabitPact, you must create an account using an email address and password, or via Apple Sign In. You are responsible for:

  • Providing accurate account information
  • Keeping your login credentials secure
  • All activity that occurs under your account

If you believe your account has been compromised, contact us immediately at contact@gethabitpact.com.

You may delete your account at any time from within the app. When you delete your account, your personal data will be removed in accordance with our Privacy Policy.

4. Pair Mode and Shared Data

Pair mode is an optional Premium feature that lets two users link their accounts to track habits together. When you enable pair mode:

  • You invite a specific partner by sending them a pairing invitation.
  • Both users must accept the pairing. No data is shared until both parties consent.
  • Once paired, each partner can see the other's habit check-ins, streaks, and goal progress for shared (pair-scoped) habits.
  • Solo-scoped habits remain private and are never visible to your partner.

Either partner can end the pairing at any time from within the app. When a pairing ends, shared visibility is removed immediately. Previously recorded check-in data remains in each user's own account.

By using pair mode, you consent to sharing your pair-scoped habit data with your paired partner. You should only pair with someone you trust.

5. Acceptable Use

You agree to use HabitPact lawfully and respectfully. You may not:

  • Use the Service for any illegal purpose or in violation of any applicable law
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or our systems
  • Reverse engineer, decompile, or disassemble the application
  • Interfere with or disrupt the Service or its infrastructure
  • Create multiple accounts to circumvent free tier limits
  • Use automated scripts, bots, or scrapers to interact with the Service
  • Use habit names, reward descriptions, or any other user-provided text to store or transmit illegal, abusive, or harmful content

6. User Content

HabitPact allows you to enter custom habit names, goal names, and reward descriptions ("User Content"). You retain ownership of your User Content. We do not claim any intellectual property rights over it.

By entering User Content into the Service, you grant us a limited, non-exclusive license to store and display that content solely for the purpose of providing the Service to you (and your paired partner, if applicable). This license ends when you delete the content or your account.

HabitPact is not a social platform. There is no public profile, no feed, and no messaging. Your User Content is visible only to you and, in pair mode, to your paired partner for pair-scoped items.

7. Intellectual Property

The HabitPact application, website, design, logo, mascot, icons, and all related content are owned by us and protected by copyright and other intellectual property laws. These Terms do not grant you any right to use the HabitPact name, logo, or brand in any way beyond normal use of the Service.

The Service may include open-source software components, each governed by its respective license.

8. Subscriptions and Payments

Premium features are available through in-app purchases managed by Apple (App Store) or Google (Google Play). By purchasing a subscription:

  • You agree to the pricing and renewal terms displayed in the store at the time of purchase.
  • Subscriptions renew automatically unless you cancel before the renewal date.
  • You can manage or cancel your subscription through your device's App Store or Google Play settings.

Refund requests are handled by Apple or Google according to their respective refund policies. We do not process refunds directly.

8.1 EU Right of Withdrawal

Under EU consumer protection law, you have a 14-day right of withdrawal for digital purchases. However, by making an in-app purchase and beginning to use Premium features, you acknowledge that the digital content is delivered immediately and you consent to waive your right of withdrawal once the download or access begins, as permitted under Directive 2011/83/EU (Article 16(m)). If you have not yet accessed Premium features, you may exercise your right of withdrawal by contacting Apple or Google within 14 days of purchase.

9. Service Availability and Changes

We aim to keep HabitPact available and reliable, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We may update, modify, or discontinue features of the Service at any time. If we make changes that materially reduce the functionality you have paid for, we will provide reasonable notice (for example, via in-app notification or email).

10. Limitation of Liability

To the maximum extent permitted by applicable law, including Polish and EU law:

  • The Service is provided "as is" and "as available" without warranties of any kind, except those implied by mandatory law.
  • We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
  • Our total liability for any claim related to the Service is limited to the amount you have paid us in the 12 months preceding the claim, or 50 PLN, whichever is greater.

Nothing in these Terms excludes or limits our liability for fraud, gross negligence, willful misconduct, death or personal injury caused by our negligence, or any other liability that cannot be excluded under Polish or EU law. Your statutory consumer rights under Polish law (Civil Code) and EU consumer protection directives remain unaffected.

11. Disclaimer

HabitPact is a habit tracking tool, not a medical, health, fitness, or therapeutic service. Nothing in the app constitutes professional advice. If you have health concerns, consult a qualified professional. We are not responsible for any decisions you make based on data displayed in the app.

12. Termination

12.1 By You

You may stop using HabitPact and delete your account at any time. If you have an active Premium subscription, cancelling your account does not automatically cancel the subscription. You must cancel the subscription separately through Apple or Google.

12.2 By Us

We may suspend or terminate your account if you violate these Terms, particularly the Acceptable Use rules in Section 5. Where possible, we will notify you before or at the time of suspension and give you an opportunity to address the issue. In cases of severe or repeated violations, we may terminate access immediately.

Upon termination, your right to use the Service ends. Sections that by their nature should survive (including Sections 6, 7, 10, 11, and 14) will remain in effect.

13. Changes to These Terms

We may update these Terms from time to time. When we do:

  • We will update the "Last updated" date at the top of this page.
  • For material changes, we will notify you via email or in-app notification at least 30 days before the changes take effect.
  • Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
  • If you do not agree with the updated Terms, you may stop using the Service and delete your account.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Poland, without regard to conflict of law provisions. The mandatory consumer protection laws of your country of residence continue to apply where required by EU Regulation 593/2008 (Rome I).

If you are a consumer residing in the EU, you have the right to bring proceedings in the courts of your country of residence.

Before taking legal action, we encourage you to contact us to resolve the issue informally. You may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

15. General Provisions

  • Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
  • Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full effect.
  • No waiver. Our failure to enforce any provision does not constitute a waiver of that provision.
  • Assignment. You may not assign your rights under these Terms without our consent. We may assign our rights and obligations to a successor in the event of a merger, acquisition, or sale of assets, provided your rights under these Terms are not diminished.
  • Language. These Terms are written in English. If there is any conflict between the English version and a translation, the English version prevails.
